Use of the SpottedGhosts.com Products

You agree to use SpottedGhosts.com Products responsibly and appropriately and shall not do anything unlawful on or in relation to any SpottedGhosts.com Products, including but not limited to:

  • any act that would constitute a breach of the legal rights of any person
  • anything to defame or libel SpottedGhosts.com (including our employees or other individuals) by posting or transmitting any material which is defamatory, discriminatory, threatening, harassing, intentionally misleading or invasive of another person’s privacy
  • anything which infringes any intellectual property or proprietary right of any person

You agree that you will not:

  • access any SpottedGhosts.com Products to obtain information with the objective of building any similar or competitive product
  • change, make derivative works of, disassemble, reverse compile or reverse engineer any part of any SpottedGhosts.com Products, or
  • copy, reproduce, distribute or republish any part of any of the SpottedGhosts.com Products

We reserve the right to without notice take down, remove or delete any material or information you post or transmit to our Platforms.

Copyright Infringement and DMCA Policy

If You believe that material located on or linked to by any SpottedGhosts.com Products violates your copyright, You are encouraged to notify us through the Contact form in accordance with the Digital Millennium Copyright Act (“DMCA”) Policy. We will respond to all such notices, including as required or appropriate by removing the infringing material or disabling all links to the infringing material. In the case of a visitor who may infringe or repeatedly infringes the copyrights or other intellectual property rights of any SpottedGhosts.com Apps or others, we may, in its discretion, terminate or deny access to and use any SpottedGhosts.com products. In the case of such termination, we will have no obligation to provide a refund of any amounts previously paid.

This Agreement does not transfer to You any SpottedGhosts.com, SpottedGhosts.com Products or third party intellectual property, and all right, title and interest in and to such property will remain (as between the parties) solely with SpottedGhosts.com. SpottedGhosts.com, the SpottedGhosts.com logo, and all other trademarks, service marks, graphics and logos used in connection with SpottedGhosts.com and any SpottedGhosts.com Apps, are trademarks or registered trademarks of SpottedGhosts.com or licensors. Other trademarks, service marks, graphics and logos used in connection with the Service may be the trademarks of other third parties. Your use of the Service grants You no right or license to reproduce or otherwise use any SpottedGhosts.com or third-party trademarks.

Restriction of Access

We reserve the right to restrict, suspend or terminate without notice your access to any SpottedGhosts.com Products or any feature of any SpottedGhosts.com Products at any time without notice and we will not be responsible for any loss, cost, damage or liability that may arise as a result.

Indemnity

You agree to indemnify and keep indemnified us, and our officers, employees and agents, against any claim or demand made by any third-party due to or arising out of

  • your use of any SpottedGhosts.com Product;
  • your breach of the Terms or any applicable laws or regulations; or
  • your User Content.

Purchases

All payments/purchases for any SpottedGhosts.com Mobile Apps are provided through third party app stores (such as the Apple App Store and the Google Play Store). They handle all of the processing for payments and refunds.

All payments/purchases for any SpottedGhosts.com Products (other than Mobile Apps) done through our website are via Paypal.

App Subscriptions

Some SpottedGhosts.com Mobile Apps allow you to have a monthly or yearly subscription, at a small price (dependant on the Mobile App). If you wish to cancel the subscription, you can do so in line with the Google or Apple app subscription terms and conditions, via your device. The subscription is non-refundable through SpottedGhosts.com. You can cancel within the time period that either Google or Apple give you.

Refunds

If you need a refund for any of our Mobile Apps then please get in touch with the app store that you purchased any SpottedGhosts.com Apps from, either Google or Apple. They are the seller of the SpottedGhosts.com Apps and they have their own refund policies. We do not issue refunds for any SpottedGhosts.com App purchased from 3rd party app stores (such as Google or Apple).

If you would like a refund for any product purchased through our website (Shop Products) then please get in touch with us within 14 days of the delivered date. Products need to be returned in the original state and packaging, as when sent to you. You will be liable for return postage costs. We can not be held responsible for any damaged product while in transit. Products posted to you via a 3rd party postage company will be insured to a certain amount so we can claim from our end if any damage occurs. Refunds will only be issues when the returned product has been received by us and been checked, along with all original packaging and contents.

Returns

If you are not satisfied with any products purchased through our website then you can return it/them within 14 days of the delivered date. Please get in touch with us so this can be arranged. As above, Products need to be returned to us in the original state and packaging when sent to you. You will be liable for the return postage costs. If you are returning a product to us then it is your responsibility to insure the postage of the product, should any damage (or anything, including, but not limited to, lost in transit) happens to the returning product. We can not be held responsible for (but not limited to) any damages or losses when returning the product(s) to us.

As mentioned, when we post a product to you it is insured for a certain amount. We will do our best to help keep your costs down in returning Shop bought product to us if it is damaged. Usually, you will get a full refund of the original product price purchased though our website, but if the product is delivered to you damaged, upon receipt back to us and once we receive our insurance payout, we should be able to pay back the postage and return postage to you as well (only for damaged products) but this is not guaranteed and is only if the product is delivered to you damaged. If we received a damaged return that was not damaged when you 1st returned it, then it is your responsibility to have the shipment insured as we will not be able to issue a refund.

Customs Duties and Taxes

You will be responsible for any customs fees, duties or any additional costs incurred beyond the original purchase price from our website. We do have any control over these fees or delays.

Delivery / Package Refusal

If a package is refused, non-deliverable or duties are not paid (as required by your country), any applicable refund will be deducted for any return shipment, abandonment fees and any other fees incurred for the return of the product(s). If the package is abandoned then NO REFUND will be issued as it will end up being destroyed. Put simply, it is very likely you will not receive a refund as refusal and return fees are costly. If you don’t want the item then it is far easier to accept the package and then get in touch with us so that we can work something out afterwards. Having customs or shipping parties involved incurs more fees that we can help avoid.

We are not responsible for items confiscated, lost, stolen or otherwise not delivered to the purchaser. SpottedGhosts.com is not responsible for customs fees, duties or any additional costs incurred beyond the original purchase price. Also, we cannot change item values, mark as a ‘gift’ or reduce the value for you.

Deliveries

Unless otherwise stated, any products purchased through our website shop will be sent to the address provided to us via Paypal. Your delivery address can be changed from within your account section of this website.

International deliveries can take a couple of weeks to reach the final destination All deliveries are tracked and a tracking number can be provided so that you can also track the shipment.

All deliveries are done through tracked/signed for delivery options, unless otherwise stated and tracking numbers can/will be provided.

Shop Business Hours

Our shop working hours are from 9am to 5pm (GMT) Monday to Friday. Any orders placed outside those hours will be processed the next working day. If orders are placed on a Friday then the next working day that they will be processed is Monday.

Prototype Products

Sometimes we sell prototype products cheaper than the final product price. These terms and conditions also apply to prototype products, so you (and we) are still covered.

Prototype products are just as good as the final products, the only difference is that they have been slightly used for research/development and/or testing purposes.

Shop Products

All products sold via our website shop are designed and manufactured by S:G Technology Ltd (Company Number: 15865640). They either own all of the intellectual property rights for their products, or are licensed to use the intellectual property. We are simply the licensed reseller of their products and handle all of the sales and refunds for them. S:G Technology are also a developer of paranormal mobile apps that we are also licensed to distribute.

Warranty

All Products purchased through our website shop come with 12 months warranty (including purchased prototypes).

Failure to Comply

Failure to comply with these terms and conditions may result in legal action being taken against individuals or entities.

Spotted: Ghosts, SpottedGhosts.com and Spotted Ghosts Ltd are a licensed distributer of all mobile apps and shop products available on or via this website. When referring to “our” products, they are either our products or the products we are licensed to distribute.
